Inspection, Monitoring, & Reporting

The Guardian Trust develops and provides remedy-specific inspection, monitoring and reporting programs for Land Use Controls (“LUCs”) and Engineering Controls (“ECs”) based upon the results of The Guardian Trust's site acceptance process. Monitoring plans will vary depending upon the frequency of monitoring, the size of the site, the complexity of the LUCs and ECs and any regulatory requirements.

Physical Inspections and Monitoring:

Physical inspections of each site by qualified professionals are conducted on a regularly scheduled basis depending upon the agreed upon remedy and any applicable regulatory requirements. In addition, the responsibilities of The Guardian Trust to monitor a site range from inspecting ECs such as a pump and treat systems, fences, caps and other structures, to actually collecting samples to assure that the ECs are functioning properly. These inspections can also involve monitoring to assure that the site continues to comply with LUCs such as restrictions on specific land uses. Information gathered from physical inspections of sites is maintained in the The Guardian Trust database and is made available to interested stakeholders.

Periodic Reviews of the Land Records:

In addition to inspection and monitoring services, The Guardian Trust conducts periodic reviews of the land records to monitor transfers or recordations to assure that they are consistent with LUCs and any property interest held by The Guardian Trust.

Reporting:

The Guardian Trust provides monitoring reports on a regular basis to designated stakeholders. In the event of a failure or breach of an LUC and/or EC, The Guardian Trust will notify designated stakeholders based on a previously established protocol developed with the client and the appropriate regulatory agency(ies). Following notification, The Guardian Trust can verify that the necessary actions have been taken in response to such failure or breach.
